Concerns Around AHPRA’s New Powers: What Practitioners Need to Know

As of 1 July 2024, sweeping reforms to the Health Practitioner Regulation National Law have come into effect. These changes give AHPRA and National Boards significantly greater authority, particularly over unregistered and suspended practitioners. While these changes are presented as public safety measures, they raise important questions about procedural fairness, especially for those defending practitioners against disciplinary action.

Expansion of AHPRA’s Powers: Interim Prohibition Orders

One of the most concerning changes is the introduction of Interim Prohibition Orders (IPOs). AHPRA and the National Boards now have the ability to prohibit unregistered practitioners, including those suspended, from providing any health services where AHPRA considers they pose a “serious risk” to public safety.

This broad and discretionary power raises critical issues for those practitioners who may find themselves subject to restrictive orders without a fair opportunity to respond. There is real potential for reputational harm and loss of livelihood even before any formal findings are made.

Control Over the Public Register

The reforms also introduce changes to the public register, allowing it to include not only a practitioner’s legal name but also any alternative names (such as traditional, shortened, or anglicised names). While this is marketed as enhancing transparency, it may compromise privacy and expose practitioners to unnecessary scrutiny, particularly in culturally sensitive contexts.

Withholding Information for “Practitioner Safety”

AHPRA now has expanded discretion to withhold information from the public register where it considers that publication would pose a risk to the safety of the practitioner, their family, or close associates. While protection of practitioners is important, the highly subjective nature of this test means it may be unevenly applied, leading to further uncertainty in an already opaque process.

Registration Renewals Post-Suspension

Practitioners who have been suspended now face a formalised process to seek renewal of registration. While having a process in place is arguably positive, there is concern about the lack of clarity around the evidentiary thresholds and timelines involved, potentially leading to prolonged delays and administrative hardship.

Conclusion

These reforms form part of a broader trend towards expanding AHPRA’s enforcement powers, with previous reform stages rolled out in October 2022 and May 2023. While the stated aim is public protection, the reality for practitioners is a system that is becoming increasingly punitive and difficult to navigate without experienced legal support.

It is therefore vital to remain vigilant. The increased scope of AHPRA’s powers places unregistered and registered practitioners alike at greater risk of regulatory action, underscoring the importance of legal representation and early intervention when dealing with any investigation or notification.
